Cancellation Policy

Sailing Foundation Release of Liability Form Seal Beach Yacht Club Sailing Foundation, a non-profit corporation RELEASE OF LIABILITY, INDEMNITY and HOLD HARMLESS AGREEMENT AS a condition of using a vessel of Seal Beach Yacht Club Sailing Foundation ("The Foundation") pursuant to the Terms of Use, I realize that whenever I am using its vessel, I am subject to both normal and unusual risks of harm, injury and damage. I am solely responsible for myself, my passengers, and the vessel itself. RELEASE OF LIABILITY: I rely upon my own knowledge and experience and I will not rely upon The Foundation, its members, officers, representative and staff, nor hold them responsible for any injury up to and including death or damage to me and my guests to the fullest extent allowable by law, and waive Calif. Civil Code Sections 1542 and 2778, if applicable, to the extent SlBYCSF's insurance coverage is not applicable and available (including any deductible to the coverage.) The undersigned further acknowledges that signing this Release is a requirement for use of said vessel, and that he/she is waiving all rights to bring a legal action to assert a claim against SlBYCSF, even for its negligence. INDEMNITY AND HOLD HARMLESS AGREEMENT: I further agree to indemnify and hold harmless The Foundation, its members, officers, representative and staff from all claims of liability to person and property made by my guests and third parties arising from my use and operation of a Club's vessel and its dock. In the event that this Release of Liability, Indemnity and Hold Harmless Agreement is deficient, I agree to liquid damages against The Foundation not to exceed Two Hundred ($200.00) dollars. By signing below, I certify I have read this document and fully understand its contents contained herein and assume all such risks, and if signed on behalf of a minor for whom I am responsible, acknowledge my own responsibility for the actions of said minor, and I consent, on behalf of the minor child, to participate in the use of the vessel.
